San José migracion costa rica, 29 de abril 2003 (OIT) - Uno de los temas en que trabaja la OIT es el de las migraciones. La migración laboral internacional aumenta en las condiciones actuales de globalización y de apertura de mercados, en contraposición a la tendencia hacia el incremento de barreras establecidas por los estados contra el ingreso legal de trabajadores no nacionales.

En el marco jurídico de instrumentos internacionales para la defensa de los derechos de las personas migrantes, se destacan la Convención de las Naciones Unidas sobre trabajadores migratorios de 1990 y los Convenios no. 97 y 143 de la OIT.

En sus esfuerzos por identificar más y mejores oportunidades de trabajo para las mujeres, el programa de Género de la OIT con sede en Ginebra, ha considerado importante incursionar en la emigración laboral femenina. Este es un fenómeno social en ascendencia y hay muy poco conocimiento de las interrelaciones entre los factores económicos que motivan y resultan de los desplazamientos migratorios de las mujeres migrantes y factores sociales y culturales que son centrales para el bienestar y calidad de vida, como son la igualdad de género y las condiciones de desarrollo integral de la descendencia de estas mujeres.

En Nicaragua, el empleo femenino más allá de las fronteras está adquiriendo cada vez un peso más importante como alternativa de inserción de las mujeres al mercado de trabajo y de válvula de escape de grupos familiares que viven altos niveles de pobreza y de insatisfacción de necesidades básicas. Los países de destino de preferencia para los y las nicaragüenses son E.E.U.U. y Costa Rica.

La emigración laboral de mujeres nicaragüenses hacia el país vecino debe entenderse en un contexto de factores de expulsión en Nicaragua combinados con factores de atracción en Costa Rica. El poco dinamismo de la economía en Nicaragua genera una alta sub-utilización de la fuerza de trabajo, mientras que en Costa Rica, el dinamismo de su economía, aunado a la presión por buscar mayores niveles de competitividad internacional tienen salida en la absorción de mano de obra inmigrante, que por ser irregular e indocumentada, puede ser contratada a más bajo costo y al margen de la legislación laboral de cualquiera de los dos países.

Costa Rica granted Temporary Protected Status to Nicaraguans who fled Hurricane Mitch in 1998; TPS was ended August 1, 1999.
  • Central America. There are 500,000 to 700,000 Nicaraguans working in Costa Rica, half of them illegally; Nicaraguans are at least 15 percent of the three million Costa Rican residents. Most Nicaraguans in Costa Rica are farm, construction or service workers. Costa Rica has stepped up its border patrols in 1998, and more than 1,000 Nicaraguans a month--termed rechazados or rejects--are prevented from entering Costa Rica. Many Nicaraguans try to slip down the Rio San Juan to Costa Rica from the Nicaraguan city of San Carlos to earn wages that are six times higher than in Nicaragua. Most of the coyotes in San Carlos charge migrants $3 to be dropped off on the Costa Rican side of the border before the boat reaches the city of El Castillo. Smuggling peaks in August, before the coffee harvest begins in Costa Rica.Costa Rica and Nicaragua signed an agreement regulating seasonal migration in 1998. Nicaraguans with work permits enter Costa Rica at the well-regulated western border at Penas Blancas on the Pan-American Highway. Many Nicaraguans are of the opinion that "Costa Ricans do not want to legalize [Nicaraguan] workers because then they would have to pay them their fringe benefits."
